(1)All information and documents provided to FlexCap Solutions LLC (“FCS”) are true, accurate and Complete (2) Applicant will immediately notify FCS of any material change in such information or financial condition. (3) Applicant authorizes FCS to disclose all information and documents that FCS may obtain including credit reports and applications to other persons or entities (collectively,”Assignees”) that may be involved with or acquire commercial loans or purchases of future receivables (collectively, “Transactions”), and each Assignee and third party is authorized to use such information and documents (and to share such information and documents with other Assignees or third party) in connection with potential transactions. (4) Each Assignee will rely upon the accuracy and completeness of such information and documents (5) FCS is hereby given “written instructions” to obtain information from Applicant’s personal credit file or other information from Experian or other consumer reporting agencies solely for pre-qualifying the Merchant for business funding or other programs FCS or affiliates may offer. (6) FCS and all business affiliates are hereby given “written – instructions”‘ to obtain information from Applicant’s personal credit file or other information from Experian or other consumer reporting Agency solely in connection with such application for cash advance and other programs which may be offered (7) FCS , Assignees, and each of their representatives, successors, designees and third party (collectively “Recipients”) are authorized to request and receive any investigative reports, credit reports, statements from creditors or financial institutions, verification of information, or any other information that a Recipient deems necessary.(19) Applicant waives and releases any claims against recipients and any information providers arising from any act or omission relating to the requesting, receiving or release of information. (19) Each owner or principal further represents that he or she is authorized to apply for business funding on behalf of Merchant (20) Applicant(s) is/are jointly and severally responsible for payment of all fees and costs to related to this service. (21) Applicant agrees to pay for all legal fees and costs related to this agreement or transaction.(22) Applicant consents to do business electronically (24) Applicant agrees that any and all copies of documents are to be treated as an original.
